This website, mixavox (mixavox.com), is owned and operated by FinwelPro Co.,Ltd., a company registered in Thailand (Tax ID: 0505564018660), with its registered office at 47/4 Moo 4 Ban Kham Sao soi 5, Tbn./Amph. San Kamphaeng, 50130 Chiang Mai, Thailand. Throughout these terms, "we," "us," and "our" refer to Mixavox / FinwelPro Co.,Ltd.
Mixavox is a professional voice recording service that produces AI-generated audio content for business telecommunications, including voicemail greetings, IVR (Interactive Voice Response) menus, on-hold messages, and related audio content.
By accessing or using our website, placing an order, or otherwise using our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our website or services. These Terms apply to all users, including visitors, registered users, and customers.
We reserve the right to update or modify these Terms at any time. Changes take effect upon publication on this page. Your continued use of our services after any modification constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
Our recordings are produced using artificial intelligence text-to-speech (AI TTS) technology. The voices used in our service are synthetic neural voices, not recordings of human speakers. By placing an order, you acknowledge that you are purchasing AI-generated audio content.
While we strive for the highest quality, AI-generated speech may occasionally contain minor imperfections in pronunciation, intonation, or pacing. We offer free revisions and work with you to ensure the final product meets your expectations.
You are solely responsible for complying with any applicable laws, regulations, or industry requirements in your jurisdiction regarding the disclosure or labeling of AI-generated content when deploying the recordings in your own systems.
You must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is higher, to use our services and place orders.
All prices are displayed on our website and may be changed at any time without prior notice. Prices do not include applicable taxes (such as VAT), which will be calculated and displayed at checkout where required by law.
Payment is processed securely through our third-party payment providers (currently Stripe and PayPal). We do not store your full credit card details on our servers. By placing an order, you warrant that you are authorized to use the payment method provided.
We reserve the right to refuse or cancel any order at our sole discretion, including in cases of suspected fraud, unauthorized payment methods, or violations of these Terms.
Our products are digital audio files delivered electronically. Delivery is typically completed within the timeframe indicated on our website. Delivery times are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control.
For customers in the European Union and the United Kingdom: Under the EU Consumer Rights Directive (2011/83/EU) and equivalent UK legislation, you have a 14-day right of withdrawal from the date of purchase. However, by placing an order for a personalized digital product and expressly consenting to immediate performance, you acknowledge and agree that you lose your right of withdrawal once the creation of your customized recording has begun. You will be asked to provide this consent during the order process.
For customers in Australia: Under the Australian Consumer Law, our services come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
For all customers: Since our products are personalized digital recordings created to your specific instructions, we generally do not offer refunds for completed orders. However, if the delivered product does not match your order specifications, we will work with you to correct it at no additional cost. Each refund request is evaluated on a case-by-case basis. To request a refund or report an issue, contact us at contact@mixavox.com.
Your recordings: Upon full payment, we grant you a perpetual, worldwide, royalty-free, non-exclusive license to use, modify, distribute, publicly perform, sublicense, and resell the voice recordings we create for you. This license covers all commercial and non-commercial uses, including but not limited to: use in phone systems, IVR menus, on-hold messages, voicemail greetings, websites, videos, presentations, advertisements, and any other media or platform. You may also transfer, resell, or sublicense the finished recordings to third parties.
Background music: When you select background music for your recording, the music is sourced from royalty-free libraries and incorporated into your recording under applicable content licenses. Your right to use the music extends to the finished recording as a whole. You may not extract, isolate, or redistribute the background music separately from the recording. A certificate of licensed use is available upon request, documenting the source and licensing terms of the background music included in your recording.
Our intellectual property: All content on the mixavox.com website (including text, graphics, logos, user interface design, and software) remains our property or that of our licensors. Nothing in these Terms grants you any right to use our trademarks, brand name, or proprietary materials beyond the specific recordings you purchase.
You agree not to use our services or the recordings produced by us for any of the following purposes:
(a) any unlawful activity or in violation of applicable laws or regulations; (b) impersonation of a real individual without their explicit consent, including creating audio that could be mistaken for a specific real person's voice; (c) fraud, deception, scams, phishing, or social engineering attacks; (d) creating threatening, harassing, defamatory, or hateful content; (e) activities that infringe upon the intellectual property rights or other rights of any third party; (f) generating spam, unsolicited communications, or robocalls in violation of applicable telecommunications regulations; (g) any use that could bring our service or brand into disrepute.
We reserve the right to refuse service, cancel orders, or terminate accounts for violations of this section, without refund.
Our services and products are provided "as is" and "as available." To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that: (a) the service will be uninterrupted, timely, secure, or error-free; (b) AI-generated audio will be free of pronunciation or intonation imperfections; or (c) the recordings will be suitable for any specific regulatory requirement in your jurisdiction.
Nothing in these Terms excludes or limits warranties that cannot be excluded or limited under applicable law, including consumer protection laws in the EU, UK, Australia, or other jurisdictions.
To the maximum extent permitted by applicable law, Mixavox, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services.
Our total aggregate liability for any claim arising out of or related to these Terms or our services shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory on which the claim is based. This section does not limit liability that cannot be legally limited, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable mandatory law.
You agree to indemnify, defend, and hold harmless Mixavox and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your use of the recordings in a manner that infringes or violates the rights of any third party.
Our website may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is governed by their respective terms and conditions.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall continue in full force and effect.
These Terms are governed by and construed in accordance with the laws of Thailand. Any disputes arising from or related to these Terms shall be submitted to the competent courts of Chiang Mai, Thailand.
If you are a consumer in the European Union, you may also benefit from any mandatory provisions of the consumer protection law of your country of residence. Additionally, if you are an EU consumer and have a dispute that you have been unable to resolve directly with us, you may use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and Mixavox regarding the use of our services and supersede all prior agreements and understandings.
